Custody

Child custody issues often require our clients to make difficult choices as they navigate the details of their divorce and/or parenting plan. When decisions must be made regarding child custody, visitation rights, and financial support; emotions can run high and arguments may ensue. Post Judgment

As with any part of life, things change and your initial agreement may become outdated, inapplicable, or simply unworkable for the parties and/or their children. Although the goal should always be to avoid litigation after your case reaches a judgment, often times it is required.

Child Support

New Jersey has established uniform guideline support standards which Courts are required to follow, unless the parties agree otherwise. Support is based on two primary factors: the amount of overnight time each parent spends with the children and each parent’s income. While it may appear easy at first to simply type numbers into a computer program to calculate guideline support, there are many benefits to relying on an attorney for assistance in this area. We can guide you through the process to ensure that all income and expense factors are taken into account. There are also certain exceptions to guideline support that may be applicable in your particular situation.

Adoption

Though it is not mandatory that an adoptive parent retain an attorney, there can be many unforeseen circumstances throughout the course of the adoption process. Surrogacy

Here at Dulinski Law, LLC, we are passionate about assisting growing families throughout New Jersey through all legal aspects of the surrogacy process. We are dedicated and will work diligently to represent our clients’ best interests from start to finish and beyond. Though it is not mandatory that a future parent retain an attorney to enter into a surrogacy agreement, the contracts necessary to protect your legal right to your future child must be properly drafted.  An experienced surrogacy attorney can ensure this is handled properly for the future of you and your child.

Prenuptial Agreement

A pre-marital or prenuptial agreement is a contract entered into prior to marriage or a civil union.  A properly prepared prenuptial agreement by an experienced attorney plays a vital part in protecting your rights and your asetts in the event of divorce or death. Mediation

Not all divorce and family law matters need to be heard in front of a judge. Many cases can reach a final resolution without the parties ever having to step into a courtroom. Mediation offers several benefits to in family law matters when parties require help resolving their issues but want to avoid an all-out war or expensive litigation. Mediation is faster and more inexpensive, and it generally leads to a better outcome for all involved, due to the collaborative nature of the process. Settlement agreements that are reached through mediation are much more likely to stand the test of time. This can likely be attributed to the fact that the parties feel empowered due to their control of the process. When they finalize their divorce, they do so on their own terms, by their own agreement.
